The construction industry is notorious for fulfilling 95% of the brief on time, then taking an inordinate and unacceptable amount of time over the last 5%. Unfortunately, it is the minor snagging works that make up the final 5%, and this final phase that gets remembered.

This form a cost effective route to ensuring all works are completed on time with no reason for any further extension to the contract term and the ramifications that this may pose.

Retention Recovery

Given the current economic climate, it is of no wander that there are continuous retention disputes. This is sure to continue as clients withhold monies, often unnecessarily and undisputed.

The research group BSRIA showed that the countries leading M&E Contractors were owed a total of more than £600m by the end of 2007. Add traditional building contractors and other specialists, and the picture for retention disputes is massive.

Rententions are necessary, and will remain common place, as a means of security against the risk of failure or non-compliance by a contractor during the defects liability period. However, the retention system is open to abuse and it is not unusual for several years to pass before contractors receive the final tranche of retention. In addition, often contractors are discouraged from seeking the final payments in the promise of further work or they consider it too costly to recover the sums.
